Did you only try loosening 1 bolt in the rear axle? because there are 2. a little one, under the swingarm on the opposite side (the threaded side) you have to loosen that first and tighten it last.
 
Just cut the straps, by the way you have a nice pipe.

Dont freak out what happend is the guy who put it on did no consider the fact that you were going to have to remove it again some day to paint or what ever, so you will need to cut them this time and place them properly next time you put it back on. Its not your fault but you need to do your self a favor and cut the straps. Go ahead and order some now cuz sometimes the dealership is out.
 
Hemp - The pinch bolt should be easy to back out, but your axle is probably REALLY tight. I had to use my gorilla stregth to get mine off.
 
Before you cut them off, read the straps. They should say SAE size xx. Like brightbuell said, the dealer is out of stock. ASB has them for about $10 a piece, but any auto parts store has them for a couple bucks. They are t-bolt clamps, made by Walker, and just order the SAE size.
