If I were in your situation, I'd also be taking the bike down to the local HD shop to have them quote on the damage. That way you'll have something to benchmark the insurance adjuster's estimate against.

If this was my bike I wouldn't be worried about anything but how long will I have to wait for the check. You had carbon part broken, a ripped off kick-stand and GOD only knows what may have been tweaked in the fall. I would never worry about the guy who hit me or that my bike may get totaled. I would want the bike in the condition it was before the accident or I'd be looking for its replacement.

Some guys stall after accidents and tell you how they will pay cash and don't. Some are good intentioned and some aren't.
As Sweet Brown said so well "Ain't nobody got time fo-dat"

Glad You weren't hurt. NOW since My uncle IS an Insurance Adjuster. Do NOT let them LOW ball you. IF you were on the bike I would have screamed bloodly hell. OFF the bike just make sure you don.t sign anything with the Adjuster.
Get a New Shield for your Helment Save your Reciepts. MAKE Copies ! Then Make sure to get the Whole new Kick Stand. with bolts DO NOT settle easily these people will low ball you with the comments like well I cant exactly make a expert price or Estimate something like that.
Depends on the State.
USE Dealership parts. You ride to work vehicle, then a Rental Car MUST be provided at their cost.
Wouldn't hurt to calling an attorney if you have to that works with Bikers. Get All Detailed information with copies. Do NOT give the insurance adjuster any slack. Not Rude but firm. Keep your own Detailed pictures. As Far as Carbon Fiber Parts most Companies do not cover that. JUST STOCK. Parts. Good luck. *Jimi [mad]
