Hawk EBR ecm w/ K&N w/o pipe. Problem?

So, I've cracked my second stock ECM because of the seat contacting the connectors. I intend to move the ecm so this doesn't happen again, but the problem is that Harley doesn't want to warranty the ECM. The ESP warranty people say they want to wait for a failure. This seems ridiculous, as I'm heading to Montana this month, and alaska in august. I can't afford to be stranded in the Yukon because of their refusal. Suffice it to say I'm fighting it.

The question is this: I have an EBR ecm programmed for a stock exhaust, but haven't had the time/cash to get the pipe done yet. Will running this ecm with a stock pipe and a K&N be bad for the bike? I don't want to hurt the motor, but also don't want to get stranded should they not replace the ecm before the trip. Just curious about anyones thoughts. (2009 xb12xt, fyi)

It will run a bit rich, but I don't think it will hurt anything. I would test it and see if your plugs foul or not (your biggest concern).
