^Well you can... just go to your local dmv and apply for the lost title, if they give it to you then he never registered it and it's yours, if he did register it they will tell you that you can't have the title and you've lost nothing but your time.
 
I know in Iowa and Nebraska, if a vehicle is left on a property for 30 days past an agreed upon date for storage the property owner can take full ownership. I don't know about other states but I'm sure there's probably something similar

I know this is in a lot of states. Check with the DMV and if that falls through get a lawyer and see what he suggests.

All legalities aside, I admire your persistance in trying to find the buyer who paid in full. Since there was no agreement to store the bike, and your circumstance in having to move, I believe the bike is yours to do what you see fit.

However, I see a moral dilemma. Considering the buyer was a military man, who knows what he was exposed to. My suggestion is to sell the bike(if it ends up becoming yours again), and donate at least half the money to some veteran charity. That way, you get compensated for our efforts, and the veterans will be honored for their services.

Put it up for auction describing the situation and see what happens!
 
I seriously doubt it's a "trap". This isn't the movies, people don't plan out year long heists. Something obviously happened but most shady people aren't in for long term scams.

Definitely suggest talking with a lawyer as mentioned to inquire about the laws on abandonment but I wouldn't talk with the bank as they may try to claim it if he didn't complete paying the loan. I would mention that to the lawyer though as that may override any abandonment criteria.
 
If he used the bike as collateral on the bank loan, there will be a lien against it, i.e. the VIN. You won't be able register it without clearing the title lien.

Best advice is contact an attorney who will do the paperwork and contact the bank and give you a payoff amount. You fork over the $ (if you choose) and the bike is yours again. Otherwise, the bank will take it, it then goes to auction and MAYBE you get it for less than you would've if you paid off his lien.
 
Nah, I don't mean trap like the other guy set you up way ahead of time.

I mean it's a trap in the sense of it's a complicated legal issue. Google or wiki "bailment" which is the legal term for what is happening here.

The OP has some options but the best bet is working through a lawyer.

thanks for all of the input! The guy that "owns" it was in the AF with me so for now I'm just going to talk to people from where he worked before he got out and see if they can get in touch with him. It just seems to be the easiest and most correct way to go. That's only gonna work for another month then I will hit up a lawyer...Or put the bike in the street and if anyone wants to leave a few dollars for me ?? haha jk
