I work as a medic here in Chicago and you are very lucky to be unscathed from all that for the most part. She deserves more but it won't happen. Glad you're ok though as that's what matters most. Safe riding to you and everyone else in 2013 and beyond.

I'll calm down, glad you're ok! Also good to hear that some of ur sporty might be saved. And good to know the crowd that gathered was there to make sure she got nailed and you were ok, when we ride by ourselves all we can hope is that if something like this happens that theres enough good people in cars that will do what it takes to help out a motorcyclist. I know when im in my car im always kinda lookin out for people on bikes in high traffic, for example if they are behind me and theres hazards ahead (traffic or debris or whatever) I try to give them a good warning by slowing early and flashing my brake lights. Once again glad ur OK ish!
 
I'm sorry reckless driving? Drunk driving is a felony in NY. You should sooooo press charges. Would they have labeled it vehicular manslaughter if the outcome was different? Who knows what injuries may be with you for the rest of your life? She is getting a slap on the wrist, she will never learn. HMM looked this up on the interweb
Penalties for Drunk Driving in Oregon

Under Oregon law, DUI is a Class A misdemeanor, except when the offender has been convicted of DUI at least three times in 10 years prior to the date of the fourth or subsequent offense. In that case, the offender commits a Class C felony. Class A misdemeanors are punishable by up to one year in prison, a fine of up to $6,250, or both. Class C felonies are punishable by up to five years in prison, a fine of up to $125,000, or both. Despite these potential punishments, the following DUI penalties are mandatory:

For a first conviction, the minimum fine is $1,000. The driver’s license suspension period is 90 days.
For a second conviction, the minimum fine is $1,500. The driver’s license suspension period is one year where the commission of the second offense occurred within five years of the first offense.
For a third or subsequent conviction, the minimum fine is $2,000 if the person is not sentenced to a term of imprisonment. If the third violation occurred within five years of the first and second violations, the driver’s license suspension period is three years. For a fourth conviction within a 10-year period, the offender’s driver’s license will be permanently revoked.

So was this her first...second...or subsequent offense?

Here is what i know at the moment, the Police called back with her insurance info which is good as theres a LOT of people who dont have it. Ill be interviewing lawyers next week.

And BTW, while i sometimes have my own complaints about some police officers, the ones at Portland Police i have been dealing with have been AWESOME, Gotta give appreciation to those who do that job and do it well.
Traffic division is doing a full investigation, lots of pictures, measurements and 8x10 color glossies with circles and arrows.

I already have been contacted by the County Dist Attorney, and YES im pressing charges and will go to trial, and expect more details soon.

As for the DUI that info above is basically accurate, but it fails to mention diversion for first time offenders, I dont think she should get Diversion or expungement. As for costs for DUI you are only seeing above the base fine, the real costs for a DUI with ALL associated fees is much much higher, (My dad RIP was a lawyer and never missed an opportunity to remind me of DUI costs and penaltys and must have worked as ive never had one)
But todays costs will range from the low of $7500 to $20,000 all in. Since this is a injury accident and another person involved it wont be on the low end.

then theres the insurance costs and too soon to say, but a civil tort claim can occur as well,,, in other words a massive lawsuit. Even if she doesnt have the money, a judgement hanging over her. im all for giving people a second chance and redeeming a wrong, but she did her best to kill me, tried multiple times to lie about it, tried to blame me, and im certain she tried to leave the scene, but her car was kaput.

all my clothes and boots had oil over them, i thought it was from my bike,,,, it wasnt, it was from her car.

in some ways doesnt look that bad, seats torn up, tanks pushed up, was a temp tank while i was working on my porkster tank, and the frame seems tweaked, we already removed all her car parts off the bike, there was chunks of her car wedged around the wheel and chain, wirings torn up too but i think i can save the motor

Gary Derian, I forget the name of the company he works for,, but i just emailed him, he also holds 6 patents for hi performace tire designs and worked as an engineer for a number of companys, travels a lot as an expert witness in trials,

I do know the Portland Police traffic division came out and took tons of pix, did measurements and collected evidence. I already had contact from the local DA for the upcoming trial, the reports/investigations are not complete yet. Also my FIL is a retired detective and is making calls and doing some checking,.

so the girls guilt is pretty established, but the rest of it will evolve over time. I am super thankful to everyone involved as no one can believe i lived thru this, And yes, I really did buy lottery tickets.

Those fender forgings on the XL can be chopped leaving the seat pan and you'll have the start of a nice street tracker or a bobber.

that bike is my ratty old daily rider, i was looking to sell it eventually but was in doubt anyone would want a 86 first year evo, the debate was paint the bodywork and wheels and do a cosmetic rebuild, was thinking HD Orange and black, with the Porkster tank back on it.

the other thought was a hardtail kit and stripped down bobber, but thats a lot more parts and labor, not a lot really but there is that issue. but would be way more sellable, keep in mind this is the old style 4 speed as well,

So,im figuring insurance wise its totaled, Lawyers already told me to find comparables and found 6 local good ones for between $3500 -6500.

So, depending on how bad the front section is,,,,,, im thinking a lowbrow customs hardtail kit, those are good quality, and I know Tyler and his crew, the guy who makes the kits for lowbrow is really good, and you can use the stock wheel, brakes and other parts, So once i get done with the insurance crap, thats where it will be headed, I have a LOT of bikes already,, so it will be sold anyway. but i think it can live again.

I have 4 other sportsters, plus Buells, plus others, but im not going to be riding any of them for a while...and i think im done commuting to work ... the city is just too full of distracted texting fools.

right before the accident about 3 miles back i had harrassed a lady on her phone, i could see her ahead of me yakking at the stop light so i pulled up and gave it some revs,, next light, she was still on the phone so i flipped up my helmet and yelled at her, "Get off your phone and drive"

the thought had occured to me it was the same person but it wasnt

aww cool, thanks. Yep I am looking fwd to rebuilding that SCG this fall/winter. But things have slowed down a bit.
Plus the wife had "The Talk" with me about the volume of bikes, cars and projects I have. It scared the crap out of her about the crash and wondering what she would do with all my stuff. <Best garage sale ever!>
so, yes, im downsizing the volume of stuff i have and focusing in on what matters to me most, plus more recreation and fun things.
The insurance company for the driver who ran me over wants to come look at the Sporty, At first they wanted to come out and have it towed to their inspection site, then back to me if i wanted it back, now they are going to come look at it instead. I have other sportsters so if in parts or built into a bobber it should live again.
It appears these things are complicated and so a DIFFERENT adjuster is supposed to contact me about my ruined gear, Boots, helmet, gloves, leathers and my backpack full of Ducati parts that I had bought earlier that day.
