Sidestand switch operation

Hello all,
I've just bought an 08 Buell Blast and am getting it safetied. The only issue is the sidestand switch not working right. The shop people are telling me I need to get a new switch because it is not killing the engine once it gets put in gear (with the clutch still in). But it does shut off when you put it in gear and THEN let the clutch out. Can anyone tell me if I'm wrong or the shop is mistaken?

doing its job. it's supposed to keep you from taking off with the stand down. You don't drive with the clutch pulled in so it doesn't engage till you start moving
