Product manufacturers (incl vehicles) cannot void the warranty due to an aftermarket part unless they can prove that the aftermarket part caused or contributed to the failure. Search on Magnuson Moss Warranty Act (15 U.S.C. 2302(C))
 
If they're gong to void your warranty because of a custom pipe, they better void 98% of the Harleys that go in there as well.
 
Haha, Dave that's what I told Tom this morning!

At least he's on my side and agrees that the pipe and turn signal location has nothing to do with the tranny, that's why Buell said they're keeping the block on the warranty until they pull the tranny apart, so there's hope.

The damage is in excess of 1000 dollars fyi, that's why Tom had to call Buell tech support instead of just sending them a bill.
 
The key to The MM Act is that it moves the proof of damage from the owner to the manufacturer.

Instead of the owner having to prove that the muffler does not affect the operation of the gearbox, the vendor has to prove that it does. You are always 'right' now, unless the manufacturer can prove that the modification caused the damage.

The old situation was that you were always 'wrong,' if you make *any* alteration.

Tuesday I'm supposed to get my bike back, it will be 46 days since I first came on here talking about it and 40 days in the shop [sad] Hope my riding skills come back fast :p
 
Hey Bajabomber87,

I just acquired my 1st Buell - it's an '06 XB12R - this bike does the exact thing you described in your first post above. I didn't see your bike's year but I'm wondering if you still have the repair invoice and if you have any advice as to what exactly I need to replace in the transmission. I probably will post my own troubleshoot thread on this but wanted to ask you since you've already went thru this repair.

Originally harley replaced a shift fork and a dog gear. This lasted about 3-4k miles before I started getting the same problem. After warranty was up, I rebuilt the tranny myself and the shift cam ended up being worn out causing the forks to wear prematurely.
