You don't even have to have a windscreen so having one of any color means nothing and if the colored screen is an option there is no way in any state you can get a ticket for it since it had to have been approved by the DOT before production.

Go to court and let the cop learn a lesson.

you would think but we already had one on here lose in court
yes i dealt with this, (we met at the hide out remember?) no use fighting it, you cant. the system is setup where you cant argue a fix it ticket. mine was also red, told the judge the facts, the vehicle code even specifically states "aftermarket" doesnt matter, judge says dont want us looking like cops. i went in had it removed from the motorcycle $25 and i was done. i painted the back side black and reinstalled.
 
Paint it with plasti dip if your going to paint it then you can peel it of if you ever want to return it back to stock or sell it. Forgot to take a before picture but this is after peeling it

The owner of American sport bike said this is how you beat the ticket.

IF you had the OEM windscreen on your motorcycle, the cop that wrote the ticket is in error and you will win this case. The applicable laws specifically use the word AFTERMARKET in the law. The OEM screen is NOT covered by the law, and it is legal to run. I highly recommend to all Buell owners with Amber, Blue, or Red OEM screens that came on their bike that they carry a copy of this law with them. The word “BUELL” is molded right into the OEM screen. However, if you have fitted an aftermarket ZeroGravity blue, red or amber screen to your motorcycle, then the ticket is still valid. It’s a stupid law.

This is cut and pasted right from the California Vehicle Code. Look at your ticket. The cop will usually write the applicable vehicle code section if he knows it. If he wrote this code number, he is wrong. If he wrote a different one, look it up. But I’d bet the word “aftermarket” is there if there was a different code. I just searched the Cali vehicle code and can’t find anything that would make the OEM red screen illegal.

26701. (a) No person shall sell, offer for sale, or operate any motor vehicle, except a motorcycle, manufactured after January 1, 1936, unless it is equipped with safety glazing material wherever glazing materials are used in interior partitions, doors, windows, windshields, auxiliary wind deflectors or openings in the roof.

(b) No person shall sell or offer for sale any camper manufactured after January 1, 1968, nor shall any person operate a motor vehicle registered in this state which is equipped with that camper, unless the camper is equipped with safety glazing materials wherever glazing materials are used in outside windows and doors, interior partitions, and openings in the roof.

(c) No person shall operate a motorcycle manufactured after January 1, 1969, equipped with a windshield containing glazing material unless it is safety glazing material.

(d) No person shall sell, offer for sale, or operate any motor vehicle equipped with red, blue, or amber translucent aftermarket material in any partitions, windows, windshields, or wind deflectors.

(e) No person shall sell, offer for sale, or operate any trailer coach manufactured after January 1, 1977, that is capable of being towed with a fifth-wheel device unless the trailer coach is equipped with safety glazing materials wherever glazing materials are used in windows or doors, interior partitions, and openings in the roof.

I bought a zero gravity touring shield. It is a little taller but still looks nice. This will keep the fuzz of of me in the future. I do not want to change my exhaust.
 
I would go as far as pressing charges against either the cop, judge, or state and get a good lawyer, even if it is just 25$.

Loki: i respect you and respect your opinions but....WTF are you talking about? there is no such thing in either CA or any other state. it is called "appeal process". free if you do it yourself in most states but very time consuming.
 
Not saying this would work, but part of my case IF I felt compelled to push the issue into a court room would be to ask the court to provide evidence of any other law enforcement, fire, EMT, etc that rides a motorcycle with a red windscreen. If they can't, how can you be impersonating a police officer if you what you're riding doesn't resemble that of law enforcement? I've personally never seen a cop on a motorcycle with a red windscreen. If the cant produce photos with red windscreens, I guess anyone in a uniform could be impersonating a police officer........ups driver, snap on salesmen, FedEx driver, Aramark, admiral linen, etc........they're all wearing a uniform, right? Must be a police officer because police officers wear uniforms.

I would dumb it down completely.

Also, provide endless numbers of photos of law enforcement motorcycles for comparison where none of them have red wind screens, followed by hundreds of street bikes with red windscreens to show how common it is, and that this police officer was off base.
 
Funny that this is even an issue. the top of the firebolt fairing is pretty low and you can see straight over top of it. Take a street glide or even a gold wing the front fairings on those are ridiculous and you dont see them getting ticketed.

What the issue use you have some cops that have a hard on to ticket sport bikes! Nothing we can do about it. Were you speeding or anything or was he just trying to make his quota for the onth?
 
factory windscreens have the "Buell" logo on the right top edge of the windscreen that can be used as "exibit A" , but that would hinge on the presiding judge will allow it, traffic court is usually dealt with quickly...so you would have to go to civil court with a lawyer...yes it's going to cost you, although it could go either way in the ruling, could change the law either for or against the colored windscreens in the state, but it would challenge the law, until someone does so, the state and CHP will continue to uphold that specific law, it's our right to do so and we can prove the windscreens are not "aftermarket" but OEM
 
I know yours is a aftermarket windscreen, if I was charged with a stock one,I would hire a lawyer and subeanea HD to show up in court and explain it to the judge.If it was legal to sell in Cali, why was I charged and if not then there should be a recall to fix them all at HD,s cost
 
sorry I can,t spell worth a damn some days, the who I was talking about was Heyzeus who started this thread.The point I was trying to make was if the bike came form the factory with a red windscreen and was sold that way.Would it not have to pass some sort of regulations to be sold it that state. As HD owned Buell at the time and they had sold a bike that was not legal in that state and was dragged into court to explain,would sure be intersting. This happening , slim to none.AS I said before if it was me ,I would get a lawyer an fight it.
 
After seeing this post I was kind of ticked off.. If you look in the top corner on the right side of the wind screen it clearly says DOT on it. Another point that could be made is weather or not the law was put into effect after the bike was made. Just thoughts..

I mean they are being completely reasonable.. wouldn't want anyone mistaking all the police sport bikes with ours...
 
That's funny I told the officer that The police sport bikes look completely different then Buell sport bikes.
 
This is kinda funny. I mean it sucks that you got ticketed for that and all but its just dumb. I find it quite humorous that a colored windscreen automatically dubs a motorcycle as a "law vehicle impersonation". I'm half tempted to put a red screen on my 8 year old nephews Little Tikes streetbike and parade around the local police station with a sign reading "I'm impersonating an officer. Arrest me now." lol it really is a silly situation and a stupid fine.
