Dealer CRASHED MY BIKE!

i work at a dealer to. if we wreck anything all we are liable for is the insurance. you cant force a dealer into free tires and stuff. thier insurance will cover it just like yours. bike is only worth x amount and if parts and labor are 65% of that then its totaled. the free tires and stuff are just for the dealer to save face. all they are liable for is insurance. and your insurance will probably deny the claim all day long since you didnt wreck it.

and a loaner is not a rental. its a dealer owned bike. we can loan cars to anybody over 18.
 
they told me by me signing the repai order i agreed that any damage caused to my bike will be covered by my insurence. The dealer wants to replace the frame and everything else to "do me a favor"

I dont see how they can do that what if they total your bike out, I highly doubt that its your insurance i would look at the work order and see if there is anything saying that your insurance will be used if any damages happen
 
Maybe give you insurance Co. a call and see what they say. Like 303 said i haighly doubt that they will even take the claim since you are not liable. They may be just trying to billy you into taking whatever they slap on the table. Oh and I would use a diffrent dealer for any future parts.
 
what dealership was it in mass? that is some ********. I would want my bike fixed, new frame, new headers, new everything that was damaged. and like mentioned before I would have a loaner bike in the meantime.
 
Dude talk to a "LAWYER".some will give a consult free or cheap.See what YOUR rights are.Don,t even talk to the dealer, let him do the talking.I bet they will be more than willing to co-operate with any demands including legal fees,if they have to deal with a lawsuit.
 
lawyer is best idea. we make people sign the waiver about car being driven by mechanics is your insurance. never used it though. are wash boy wrecked two trucks and did 20k in damage. we covered everything under our insurance.
 
yeah I dont see them footing the bill themselves I bet they would go through there insurance
 
here in Ca. we have a state bureau of automotive repair. I once had a complaint about a motorcycle repair, they made the shop fix it right. look under state departments in the gov. pages and call them. If they are like Ca. the shop will snap **** and quick.

I understand the whole situation and I understand that the dealer should def pay for your bike, but........how bad is the bike, like really? I low sided mine a few years back, replaced what broke, and checked the tank for leaks, it was fine and i keep riding it.
 
That's really ****** up. I'd say get a lawyer, go through theyre insurance and See about a deal on a nice and pretty 1125 (for the hassel)

the dealer wrecking your bike is total BS!! Look in your area phonebook, I'm sure there are local LAWYERS that are "biker" friendly. Then give one a call, the dealership that wrecked your bike may even be known for mistreating bikes. GOOD LUCK
 
I was getting really mad reading all the post in here untill Raven said exactly what i was thinking. Yuo probally have a cell phone...I would have called a lawyer before I even left the building. Your Insurance dosent even need to know about it, and they SHOULD NOT!!!! You dont call them, consult with AS MANY LAWYERS YUO HAVE TIME TO, unless you deal with a reputibale one already. Get on it now. Like yeaterday now. Lawyer up. What would the dealer do if you messed up one of there bikes on the show-room floor? Tell them its not personall. That is what they would tell you.

Lawyer might be necessary like everyone is suggesting.

Another option is to go through Harley-Davidson head office, customer service. Regardless of the problems we have all seen with Buell support at the dealers, I suspect that there should be some procedures in place for how the dealer should handle this type of situation (Harley or Buell).
 
your damages are what your 03s' book value is. An attorney is going to tell you to go to small claims court. Like someone said above you don't want to end up with a salvaged titled bike. The dealership has the option of fixing it, so that may be the best you're gonna get. I'de call your state bureau like I suggested and file a complaint, at least they will speed up the process.

it is common practice for most shops to test ride the vehicles after any work has been done. They want the liability off their shoulders should it break 10 miles down the road after you ride off with it. if they test drive it, and make it back safely (usually a couple miles 2-5 or so)they can safely make an argument to an insurrance company that it was working fine when it left.
 
File a complaint with the BBB ( better buisness bureau) ive had to do this before with buying a house (they tried screwing me on the price....it kept going up every time i talked to the home builder, and when i decided not to sign the contract they refused to refund my down payment as promised). sorry for my rant, but if they wont do whats right then i would report them. hell give HD support line a call and tell them your about to make the call to the BBB against both of them........dealer for doing it, and HD for letting dealers get away with that kind of crap. Just stand your ground and tell the dealer the bike that was left there had no damage history and the bike that your going to get back shouldnt have any damage history.
